Section 5
Who can file a complaint:

(1) If a family member, relative or rightful person who has the duty to take care of a senior citizen according to section 4 does not take care of him or does not arrange to take care of him, such senior citizen shall contact the relevant rural municipality for the care of the senior citizen. Or he can file a complaint with the ward chairman of the municipality. Also, if he feels that the care and upbringing of any senior citizen in his village neighborhood is not being done properly, the concerned neighbor can also file a complaint with the reason.
(2) If any complaint is received according to sub-section (1), the ward chairman shall conduct necessary investigation and reconcile between him and the family members, relatives or persons who have to nurture and care for him.
(3) If reconciliation cannot be done according to sub-section (2), the ward chairman may give a written order to the family member, relative or guardian to nurture and care for such senior citizen.
(4) According to sub-section (3), the order given by the ward chairman should be posted on the notice board of the concerned ward office and in other appropriate places.
(5) The party who is not satisfied with the order given by the ward chairman according to sub-section (3) may file an application before the relevant local level judicial committee within seven days from the date of receiving the order.
(6) If an application is received according to sub-section (5), the relevant local level judicial committee may give a written order to the family member, relative or guardian to nurture and take care of the senior citizen after informing both parties.
(7) According to sub-section (6), the order issued by the chairman of the village executive or the head of the municipality shall be posted on the notice board of the respective rural municipality or municipality and in other suitable places.
(8) The concerned person shall comply with the order under sub-section (3) or (6). If he does not comply with such an order, regardless of what is written in the prevailing law, the ward chairman, the chairman of the village executive or the head of the municipality will not be obliged to recommend any matter regarding such a person.
(9) An order under sub-section (3) or (6).A person who does not take possession of the property of such a senior citizen will only take possession of it after it is verified by the official printing department. If there is a complaint at the local level about the use, the judicial committee can entrust such movable and immovable property in the name of the senior citizen instead of him to a relative or a rightful person who will take care of him.
(10) Regardless of what is written elsewhere in this section, the local level shall make arrangements for the senior citizen's family members, relatives or persons entitled to foster care and care, or other persons entitled to care for and care for the elderly citizen, who are not in a care center and are not in care. If there is any property or part of a senior citizen who is not fostered or taken care of or is in an abandoned situation, the local level will bring it into its ownership and mobilize it for the rights and interests of the senior citizen.
